When Buona Sera Ristorante asked the Red Bank Council last September for five additional tables for it's outdoor seating area on Maple Avenue, the request ran into some flak.
The burgeoning eatery and catering hall situated across Monmouth Street from borough hall has been the subject of frequent complaints from pedestrians who say there isn't enough room between existing tables and the curb to easily pass.
They're often forced into the street, a stretch of busy Route 35 — a point made last night by resident Ben Forest. "It's very narrow there. If there's a waiter taking an order, it's just impossible" to pass without stepping into the thoroughfare, he said.
Additional foot traffic from the nearby Count Basie Theatre makes the problem worse, critics say.
Last night, resident Carl Colmorgen urged the council to look back into its own actions before approving a request by Buona Sera for a renewal of its cafe license.
Colmorgen claims that four tables on the Maple Avenue side of the restaurant were installed even though the council, citing pedestrian concerns, had unanimously rejected a request last year for five new tables there.
He urged the council, which was mulling cafe license renewals last night, to "don't forget" its own position of last September.
At the suggestion of Mayor Pasquale Menna, the council voted on and approved licenses for three other eateries — Gaetano's, Murphy Style Grill and the Original Soupman — but tabled the Buona Sera request until councilmembers Juanita Lewis and Ed Zipprich, who weren't on the dais last year, could have a chance to review the minutes.
Buona Sera owner Chris Mariani was not immediately available for comment on the matter, a restaurant employee told redbankgreen earlier today.
[Update: Borough Administrator Stanley Sickels tells us Tuesday afternoon that code enforcement was to notify Buona Sera today to remove the extra tables. "He has no approvals to put those tables there," he says.]

That restaurant is the land of the rich and snotty (with Ferraris and Lamborghini's the norm parked in front of it). They can do whatever they want! Bet on it.
It'll be so interesting to watch this one fade away and get swept under the carpet.
Of course the request got tabled! They weren't there to review the minutes! Next thing, they'll have to run out to feed the meter! Or they'll be in the bathroom so it'll get tabled again!
This case is pretty black and white to me. You can't overtake a public sidewalk like that. And this should apply to ANY business in the town.

It's actually become an extremely dangerous intersection now. They have Valet parking right there and have folks running across the street to grab extra tables from storage.
Particularly because of the ability of "right on red", I've seen at least 6 incidents where someone was almost seriously injured.
In addition, the valet parking is backing up all of Monmouth going south rush hour on Thursday and Friday because folks are double parking their cars temporarily.
How about a sign that reads "No turn on red when cougars are present"?

Why would anyone want to eat out there anyway? For the beautiful view of a busy intersection?!?
Last year, the council unanimously rejected this proposal. I argued, on several occasions, against changes that led to the sidewalks in front of Buona Sera becoming more obstructed for pedestrians. Since that time, the situation has gotten worse. While I am always pleased to see businesses meet with success here in town, council needs to recognize the congestion surrounding this location. I am hopeful that the current council will recognize that this is a public sidewalk and not create further inconvenience and danger to pedestrians.
Buona Sera food is horrible. They cover all the food in heavy gravy and sauces to mask the bad flavor of the freezer burned frozen meats and boxed pasta.
On an unrelated note, anyone know what happened to Thyme Square? They were fantastic and the last few times I've called over there the phone number is inactive. There's no way Thyme Square could be out of business and not Buona Sera.

Maybe if Buona Sera used the gold chains from some of their patrons they could secure smaller cafe style tables to the side walk That might work ! But honestly isnt it just used as a smoking lounge and taxi cab pick up anyway ? I cant see anyone actually wanting to eating out there ( or in there for that matter
I think they should make the street in front of Buona Sera one way. This way they could take the unused lane and widen the sidewalk to fit many more times the tables outside as is currently permitted by the ordinance. They could then pay into a fund to lease the sidewalk and help increase our government spendi, I mean services to the community. Buono Sera would take care of us so much, that our belly's would explode, which has always been the way I imagined exiting this place.

Here are some parking variance articles for your review regarding the restaurant. Ask yourself, how many people have received a 130+ parking variance in town. I belive the restaurant has 1 parking space of their own. This was also a 2 step variance. What gave them the right to ask for another parking variance after already receiving a large parking variance earlier.

You make all valid points.But I have a question. After they put the tables out, why did you do nothing about it? As Mr. Colemorgan stated, they were out last year. You were still on the council then. Are we to believe you had not noticed them out on the sidewalks.
Perhaps I don't understand. Had the four tables been approved in the past, and they wanted to add 5 tables or add 1 to make it 5?

Some of the outside dining does obstruct passage, are there minimum clear passage requirements. I’d hate to try and maneuver a wheel chair past some of these establishments
Wandering: They had 5 tables prior to September 2008 and wanted to add 5 more which Grace and all her other council members voted against. That would have resulted in 10 tables. The tables in the picture were in the area that was refused in September 2008.

From the statute that established sidewalk dining (http://www.e-codes.generalcode.com/codes/2655_A/2006-55.pdf):
A minimum sixty (60") inches clear, unobstructed sidwalk path shall be maintained at all times.
I wonder if any of the sidewalk cafes meet that requirement.

Thank you for bringing this to my attention. I will now bring my ruler and begin to measure the distance between tables and the curb. If any of the restaurants are in violation, I will issue tickets to help justify my salary and create a little profit center for the town.
LordJohn wishes no ill will on local merchants, but if there are rules for access, I’d expect the town to enforce them as vigorously as trash can capacity concerns.
Seems to me the best way to decide the issue. If there are code issues regarding street access that are being ignored then that raises a lot of issues.
WHAT? Does this town vigorously enforce ANYTHING? From immigrant tenant overcrowding, to jerks constantly running red lights and stop signs, to speeding, to commercial trucks rumbling fast down residential streets, to drunks running over pedestrians in known ped crossing spots, to constant tweaking zoning laws and rezoning, to constant variance issuance, to even the local school board following up on the proper residency requirements of the kids in our school, the town enforcers of RB simply DO NOT enforce ANYTHING so long as there are moneyed commercial interests behind the ruse. Sure the common shopper constantly gets a mighty parking ticket or the local resident on occasion get slammed for having a dinky garbage bag out an hour early, but if you’re connected to this town via some commercial enterprise, you’re home free. Bunch of savages in this town!
Carl, Thanks. That is the case. Buona Sera asked for additional tables, which were rejected and not put out while I was on council. I also argued against the new awnings, which I feel are an obstruction. I lost that one, but we unanimously agreed that additional tables were inappropriate. Given that the size of the sidewalk hasn't changed, I would hope that Councilpeople Dupont, Horgan, Lee, and Murphy would not change their votes this year.
Thank you Grace and Carl for clearing that up for me. I do not feel that a few tables are bad, but need to be controlled. Adding 5 more is not acceptable.
Can someone from the Borough please advise why the apparently illegal tables are still there as of tonight?
