A redbankgreen reporter was threatened with arrest by Fair Haven police today when he tried to photograph the wrecked fire department vehicle of former fire chief Shaun Foley.
The incident occurred at the borough’s public works department facility on Allen Street, where the fire department vehicle was partially covered by a tarp, says reporter Dustin Racioppi.
According to Racioppi, he entered the administrative building at the site in order to get permission from DPW supervisor and borough engineer Rich Gardella to take pictures of the car within the borough property.
Gardella was not present, but a DPW employee got him on the phone, and Gardella told the reporter that he was not authorized to make a decision, Racioppi says. Later in the conversation, Gardella denied the request.
At no point did Gardella or anyone at the facility say that his presence constituted a potential violation of trespassing laws, Racioppi says.
Racioppi says he left the property and was preparing to take photographs of the barely visible vehicle from the street when DPW workers immediately surrounded the car with garbage trucks.
Racioppi then got into his car and had just pulled out of a parking space, he says, when two police cars pulled him over.
While checking his license and registration, one of the officers told Racioppi that there were signs marking the facility as private property, and that he could be arrested for trespassing, Racioppi says.
One officer also told Racioppi that “we think you have enough information already.”
[UPDATE:] Chief Darryl Breckenridge, who was not previously available for comment, tells redbankgreen that Racioppi should have been permitted to take photos on the property or from the street.
“As far as I’m concerned, it was a misunderstanding,” he says.


























The Borough Public Works facility is private property ? and the street where the reporter was standing taking pictures not public property? Transparency at it’s best in RB/FH..
And I don’t understand why people think NJ is the most corrupt State in the union. This is like something out of a movie. I bet nobody gets in trouble….you watch.
At least one reporter tried to get the scoop.. his news agency should pursue the right to reporting and access for the public’s interest. Isnt it great to live in a community of censorship?

I’m not surprised that this reporter was treated the way that he was. Any town that would elect Mike Halfacre as its mayor is not a place that I can respect.

I’ve been to the FHDPW yard. Busy it is not, unless it’s quiting time. The street that the DPW is on is by no means a busy street. And yes you can stand on in a public street and attemt to take pictures. Should he have been stopped by the FHPD? NO! In my interpretation of the article he did nothing illegal.

Gee, I thought Red Bank officials were above the law but you people in Fair Haven take the cake. The guy was on public property and you surround him with police and garbage trucks. It should be investigated by the mayor and all those involved fired immediately. If it is not, I think Mayor Mike’s political ambitions are over. Red Bank Greenman should contact Chris Christie’s office and let them know about this event as well as the drunk driving cover ups. So if the cops receive a report of a possible trespasser, and on the way there, they see someone matching the description, they aren’t allowed to stop the guy?
Would the same apply to a burglar leaving a house he just robbed? How about a bank robbery?
Last I checked, the guy wasn’t arrested, charged, or issued a summons. He was told he was on private private property and could have been arrested for trespassing. That was it.

… harassment and intimidation take on many forms, whether a mayoral screaming match, racist vandalism to political signage, or unwarranted stops by police (“referate bitte”)…none of it should be take lightly. The FHPD needs to step up and address this; the alternative is to let a ridiculous situation fester into something far worse.

I applaud Fair Haven, in the face of a possible crime (photographing public property) not only do the police respond but DPW mobilizes their rapid response SWAT team. Neighboring town can learn a lot from this event.

We obviously do not have as much time on our hands as the Fair Haven Public Works guys and the Fair Haven Police. Shouldn’t the police be doing something constructive, like writing tickets against people for talking on their cell phone. I love when I pass the police on their cell phones, which according to them is illegal. The only difference is that I can’t issue them a $150 ticket like them seem to enjoy doing to others. And not to allow the public works guys off, aren’t there a lot of leaves that need to be picked up. Budget cuts are coming, better show your worth keeping around. Protecting a damaged car should not exactly be a priority at this time. They called everyone but the Navy to find the car crasher, so it is not really that big of a secret.

They ticket each other for cell phone violations. They write the tickets so they look busy in order to keep their jobs and then they tear up the tickets so they do not really have to pay the fine. That’s what we call a win-win situation.
Since when are all Firemen and police officers the root of all evil! The vast majority of these men and woman do a great job and never get thanked. They work midnights and holidays when you are all tucked tight in your warm beds being glad you don’t have to put your life on the line! I realize that these local police and firemen are not working in Newark but at any time something can go bad and they could lose their life and not go home to their family’s. I can’t for the life of me understand why the majority of these posts are so negative. The kid from FH made a mistake and he paid with his job and more. Is that not enough! There was no cover-up nor would there be. You are all watching too much TV and need to move on. Can you imagine if you all put this much energy into something positive, Wow what a difference that would make but I guess this is where we have lowered ourselves to. It is just a shame. I am glad there are so many perfect people out there judging us all so we should be in good shape-guess what we are not! Start being positive it may help!

I am not anti-cop or anti-fireman. I am anti-bs. And that seems to be what is going on here. They are protecting their friend and going beyond their normal duties to do so. That is why the majority of the people are so negative about this story. They know if they had done something even remotely similar they would have ended up in jail with an extremely high bail. Most people would have also lost their jobs as it was very public and would call into question a person’s character and liability exposure to their employer.

Permission to photograph is not required in the US. Unless you are photographing the base supports of the George Washington Bridge, no permission is required.

I think people just need to get there facts in order before they start speaking as if they were there and observed the incident. It is easy to sit back in this type of forum and blow the whole thing up but I don’t feel as though it is fair. People get DWI’s all the time and run and cause alot of problems but if they are in the private sector would it get this much attention? These people don’t mind being held to a higher standard but it should not be so high that it is impossible to reach!

I agree that had it been someone in a private vehicle it would not have gotten the attention that it did. First of all, if he was going to drink and drive he should not be using a public vehicle. As a police officer he should understand more so than others, the dangers of drunk driving. I obviously do not know the entire story but if he was so drunk that he hit a pole within blocks of leaving a bar, someone should have stopped him and offered to take him home. Had he just stayed with the vehicle, very few would have even known about this but he chose to jump in the river causing a major search and rescue operation. I also understand that alcoholism is a disease and hopefully he is getting help with that. I do feel bad for him as he has done a pretty good job of ruining his career and embarrising himself. I do not know this person but from what I have read, everyone seems to indicate he had a serious drinking problem for a while and if people were good friends they would not allow him to jeopordize his life as well as others by letting him drive around town drunk.

As I understand it, except for possible national security sites covered by federal law (hardly the FH junk yard), you can lawfully photograph whatever your eyes can see.

I don’t find this incident as troubling as some of the commenters here, but the FH Police Chief acknowledged that his officers’ behavior and that of the DPW workers was not correct.
I don’t want to make a mountain out of this molehill, but it is troubling to have police telling the press when the press has enough information.

GoogleMaps takes ’street level’ pics of private property. Do a google on your home address, there will be your house for all to see! This is a load of garbage saying he was trespassing.
As to comments to my first post, to get out of the rinky town if I dont like it. Yeah, well, these are not supposed to be rinky tink towns in terms of how they are run. But unfortunately, the small groups in power bending the system have made it this way. Meanwhile the majority of folks, good honest hard working folks riding the ferries and trains to NYC everyday, etc…they provide the backbone of the tax ratables and keep these towns afloat. So while they are out working all day, no one is around watching these local stooges running these towns. Read the newspaper. The State is refusing to give local municipalities aid, which may result in a law suit. You know why? The state wants sweeping change and cuts, just like has been going on at the state level.

Extreme example, yes, but the simple fact that a public works yard is public does not give anyone the right to do what they want.
The reporter should have contacted who ever is now in charge of the fire department and asked for access to the car. You wouldn’t ask the fire chief if it was okay to photograph a garbage truck, would you?
It would have been a much more professional way to approach things. As it is, he has aggravated an already ugly situation.
It was only a matter of time until this “Good Old Boys Club” was exposed. Thank you Lord John. Keep up the good work. This is truly small town politics at it’s worst.

DHF- the reporter did ask for permission, calls were made- permission was denied. He then took a picture from te street, climbed in his car and started to pull out, were he was pulled over by police and threatened tat he could be arrested for trespass. No lawyer spin can deflect the fact that 1. he did not trespass, 2. taking a pic from the street of any building is not illegal wen used for press.
Maybe RB/FH should have a press gestapo office where they can screen any and all reporters and instruct them as to how to conduct reporting? That way all your party bosses and hack lawyers in power can ensure NO transparency.

Yes, I think a pedophile has a right to take photos in a public library or a public park. Security does not always trump liberty.
I don’t think this case is about security. I think some people made small mistakes trying to protect a friend (who frankly could use some protection from the maelstrom around him). I sympathize with the employees involved, and I don’t think this is part of any grand cover-up.
But because it’s public employees protecting a quasi-public official from the press, it’s a little troubling.

And while not a danger to society like a pedophile, what this chief did was also a danger to society as well. And therefore society has a right to know so as to keep this form happening again. And to be assured the public officials in charge are doing ’something’ about preventing this kind of thing happening again.
Public Works, to my knowledge by it’s very name, is public property. I guess the workers were afraid of being caught on camera playing cards on the job, as has been witnessed around many of the public works yards in this area. Hehe
That aside, we need to get to the bottom of this. Who enabled this fellow to do what he did? And why? And why was he given a second vehicle after crashing the first one?
He has his own debt to society to be paid. That’s his business now. Now, we need to scrutinze the policies and how things were handled leading up to this mess.
And, for anyone paying attention to this story who lives in Red Bank – where we have far too many bosses and chiefs and minions driving far too many borough owned vehicles – this is a poignant reminder that tax payer money is being flat out wasted on what amounts to perks for public employment. These practices necessitate further scrutiny across the board.

Why not? He was the sworn Boro Chief. If you read the PD report that is posted on RBG, he was not cited for any wrong doings for his first accident. It was treated as just that, an accident, so why shouldn’t he drive another vehicle? People do it all the time…they have an accident, they get an insurance rental the next day while their car gets fixed or they buy a new one. Now, if he was cited and there were no repercussions, then yes, I would have a problem with him getting a second car, but that was not the case.
Scrutinize the polices?
Did you attend the Boro Council meetings last year when they discussed/adopted a Boro Driving Policy? They have policies in place that address all these scenarios, including accidents and DUIs. If you didn’t like the way they were presented/adopted, you should have spoken up during the council meeting.
There’s really no bottom to get to…we ALL know the facts and what the outcome will probably be after his court appearance. We know his quit the PD and FD. We know he will NOT be driving a FH or Rumson-owned vehicle ever again (hope he doesn’t drink & drive, either). Hope this answered your questions.

Mike, i have no issue with freedom of the press. I have issues with the press thinking that freedom allows them to do whatever they want, and subsequently inflame an already volatile topic. Should have been handled better, more professionally.

Get over it people. One guy screwed up, wrecked a truck, and jumped in the river. It’s over. He was criminally charged, lost his job, and his position with the fire department. All deservedly so.
But one individuals mistakes are certainly no indication of an underlying problem within the emergency services. I am not aware of any other incidents, at least locally, which would indicate a problem that needs this much scrutiny. It’s overkill. Move on.

And the press inflaming a topic? How about the jack-asses who used the garbage trucks as a shield? What did that have to do with their profession? How about the police who showed up or the person who called in a trespasser? One way or another, somebody inflamed the situation, either the employee on the phone or the police officers.
Here is a reporter trying to cover a story of public interest and having to go through the gauntlet to get his information. This gauntlets had nothing to do with legal or safety issues, but instead they were created by the unprofessional behavior of Fair Haven Employees.
“Move On” Didn’t we “move on” last time Shaun crashed our municipal vehicle? And look what happened.

How hard would that be? If the Chief dodges or avoids, then you take the next step. But at least it’s not causing another controversy right off.

The Foley story fits the “hyperlocal” emphasis of this blog. Who but RBG would send a reporter to photograph the wrecked car? (Here’s an interesting hypothetical: if the Asbury Park Press had sent a photographer, would s/he have been treated the same as the intrepid RBG reporter?)
Nothing brings out the fiery comments on this site like a story on firefighters. This site is rife with people who will attack anything government-related. When they criticize McKenna, no one really wants to come to his defense. But criticize a volunteer firefighter, and a crowd will come to his defense.

There’s many fine folks who are volunteer fireman. Foley was not one of them. Mayor and Council asked for an investigation in March 2008 and were stonewalled by the boys in blue. The FHFD is to blame for promoting this jerk and letting him drive a Boro vehicle. They all knew he had a problem. The cover up was done in 2008 by the PD.

Laura, thank you for translating. I’m not sure you should be calling ED’s spanish “bad” when it could possibly be the babelfish translation system u are using. For example, Ed said he was available for dinner tomorrow, not morning dinner. Those translating webs are usually not perfectly accurate, that’s why I try to read it in Spanish and take away what I can.
I think mexican nationals who are working here are grossly misrepresented. Most are hard working and would love to have the opportunity to have legal status. So instead of political sound bites by pols and officials who seem to cater to the idea of illegal aliens and cheap labor for their own gardens , I say that the same officials and pols privately sponsor their own Mexican employees as their employers so that they can have legal status here in the USA. A mexican representative in council would be great too, since they are a growing minority and find a venue for hard working illegals to become legal. Anything less would be hypocritical IMO.
Yes, tomatosauce, I agree that allowing an easier path toward legality for the Mexican population would help them assimilate,… and join the ranks of disgruntled taxpayers.

Now that the leaf season is over I will disappear to Florida to become the head gardner at the Tiger Woods estate. Mrs. Woods is going to get back at Tiger with me and I do not care if she uses me. I don’t EVER recall seeing a fire chief vehicle being put out for bond in Fair Haven. That says to me that Fair Haven residents have NEVER paid for one. That tells me that the members of FHFD worked their butts off cooking fish dinners and slinging beers to you people last summer to come up with the money to buy one. If anybody should be angry it should be them not YOU! Three weeks of set up eight nights of fair and three weeks of break down. Does not sound like a bunch of lazy drunks to me. Sounds like a lot of hard work and dedication to me. You have 27 year old feild commanders leading our troops in Afganistan. Think before you type people. That fire chief will get the same pay as you if you join on monday NOTHING! Not everybody is crooked. Go FHFD! The people of Fair Haven are behind you.
