Reddan’s lawsuit alleged the bar and liquor store negligently hired, trained, and supervised employees and had lax practices to prevent them from serving intoxicated patrons.
“The industry standards for what reasonable steps a server should take to determine if a patron is visibly intoxicated are well established in training programs,” wrote toxicologist Mitchell J McCabe in an expert witness report submitted by Reddan’s attorneys in the case.
McCabe and a second expert witness also cited the bar’s lack of written policies and up-to-date training to prevent staff from serving people who are already visibly drunk.
“The Globe Hotel’s indifference towards implementing and enforcing responsible alcohol service created conditions in which its staff were set up to fail,” McCabe wrote.
In written responses filed with the court, attorneys for all three businesses denied the allegations, saying the plaintiff’s injuries were solely the result of his own actions.
A Red Bank Police report submitted as part of the expert witness reports said police were called to the train station for mistaken reports of a pedestrian struck by the train shortly after 10 p.m. on February 12, 2022.
Police officers found Reddan lying unconscious under the platform, the report states. He was treated at Riverview Medical Center for undisclosed injuries.
